Welcome to Rank The Globe™ (the “Rank The Globe” App), a crowd-source interactive ranking platform of World Ranking, Inc. (“WR”).

WR provides features and services to you when you visit or use RankTheGlobe.com, or use the Rank The Globe™ App (each, a “Service” and collectively, the “Services”). RankTheGlobe.com (ranktheglobe.com) is the limited web version of the Rank The Globe™ App.

By using these Services, you agree to these terms and conditions, and represent that you are at least 13 years of age or older.

USER LICENCE

As long as you comply with these Terms of Use, WR grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to make personal, educational, academic research and non-commercial use of the Services. The Services, or any part thereof, may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited in any way for any commercial purpose without the express written consent of WR. It is forbidden to modify, recompile, reverse engineer, or create derivative works of, the Services, or any part thereof. WR retains all rights not expressly granted to you in these Terms of Use.

COPYRIGHT, USER CONTENT, AND COMMUNITY RULES

Texts, logos, images and graphics, scripts, functionality, overall design and layout, and all other components or elements that constitute the user interface and software architecture of any of the Services, are the intellectual property of WR or its licensors, and are protected by Canadian and international copyright laws.

Rank The Globe™ and Your World. Your Voice.™ are unregistered and/or registered trademarks or trademark components of World Ranking, Inc. The trade names, -marks or -dress of World Ranking, Inc. may not be used in any commercial activities unassociated with World Ranking, Inc.; or in any manner damaging or defamatory, to the image, brand recognition, and reputation of, World Ranking, Inc. and its Services.

By participating in content creation, such as publishing any content or information on rankings, ratings, recreation boards, any other boards, board items, and/or through communication features (comments, discussion rooms, private messaging), you are responsible for the content you published, and for adhering to all applicable local and national laws.

As a content creator, you represent and warrant that you own or otherwise control all of the rights to the content you published on any of the Services, and that your content:

Is not illegal, fraudulent, defamatory, misleading, profane, or obscene;
Does not incite any criminal behaviors or practices; victimize or exploit minors;
constitutes fair use or fair dealing (e.g., satire, criticisms, reviews, reputation-based protection for consumers, informational, educational), if applicable, and does not infringe on the intellectual property and other proprietary rights of anyone; and
Does not include private or personal identifiable information (PII) of anyone, such as contact information, addresses, credit card number, etc.

You also agree to not engage in the following actions:

Publish duplicate content repeatedly or chain letters
Publish anything unintelligible or any content that undermines the general content quality
Publish links to external sites or content on public channels (e.g. ranking boards)
Publish content that includes commercial advertisements and marketing schemes of any kind
Use the Services for commercial purposes of any kind, such as business meeting polls and customer surveys, without the express written consent from WR
Use the Services for political campaigns or fundraisers of any kind
Use any automated device, script or “robots” that enables the publishing of content, the registration of accounts, web-scraping, or other unauthorized actions or requests
Register using a false email address or impersonate anyone
Distribute viruses, malware or other harmful components

WR reserves the right, at its sole discretion, and without any obligations to do so, to monitor, review, restrict, or remove user content; and to ban or delete user accounts, with or without notice, at any time.

When you publish any content, such as a ranking or rating, on the Services, you grant WR a perpetual, irrevocable, royalty-free, fully-paid, nonexclusive, worldwide license for unrestricted use for any of the following purposes, including without limitation the right to copy, compile, reproduce, publish, distribute, sell, publicly display, publicly perform, and create derivative works of such content in any media, form or format; and to sublicense or otherwise authorize third parties to exercise any or all such rights.

APP PERMISSIONS

When you use the Rank The Globe™ mobile app, you may grant the app certain permissions for your device. Certain features of the app may require specific permissions to function. Information on app permissions is available on most mobile devices.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE SERVICES ARE PROVIDED BY WORLD RANKING, INC. ON AN “AS IS” AND “AS AVAILABLE” BASIS. UNLESS AS EXPRESSLY SPECIFIED HEREIN, WORLD RANKING, INC. MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SERVICES OR ANY CONTENT, MATERIALS OR INFORMATION MADE AVAILABLE TO YOU THROUGH THE SERVICES. YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY ALL APPLICABLE LAWS, WORLD RANKING, INC. DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, OPERATE UNINTERRUPTED, ERROR-FREE, OR THAT OUR SERVERS OR ELECTRONIC COMMUNICATIONS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULL EXTENT PERMISSIBLE BY ALL APPLICABLE LAWS, WORLD RANKING INC. WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY SERVICES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES.

INDEMNIFICATION

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS WORLD RANKINGS, INC., ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS AGAINST ANY CLAIMS, LOSSES, LIABILITIES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO ANY ACTUAL OR ALLEGED BREACH OF YOUR REPRESENTATIONS AND WARRANTIES TO THE FULL EXTENT PERMISSIBLE BY ALL APPLICABLE LAWS.

APPLICABLE LAW

You agree that applicable Canadian federal and Ontario laws will govern these Terms of Use and any dispute of any sort that might arise between you and WR.

PROCEDURES FOR DISPUTE RESOLUTION

You agree to first attempt to resolve any disputes informally before resorting to formal methods of dispute resolution. This involves contacting the other party directly to discuss the matters in dispute, and finding a mutually agreeable solution. If the dispute cannot be settled informally, you agree to proceed to mediation. If the dispute remains unresolved through mediation within 30 days, it will be resolved through binding arbitration. The arbitrator’s decision will be final and binding, and judgment may be entered in any court having jurisdiction thereof. The mediation and arbitration will be conducted in Ontario, Canada; and administered by the respective mediator and court-selected arbitrator in accordance with their rules and procedures.

OPERATION OF THE SERVICES

WR reserves the right, at its sole discretion, to modify, update, suspend, or discontinue any and all of the Services, with or without cause, at any time.

MODIFICATION

WR reserves the right, at its sole discretion, to modify and update these Terms of Use from time to time. You agree that your continued usage of the Services after any change or update constitutes your acceptance of these terms. We will post a written notice on the Services regarding the changes.

SEVERABILITY

Should any part of these Terms of Use be in conflict with any applicable law, or be deemed invalid, void, or for any reason unenforceable, the rest of the terms shall stand.

NON-WAIVER OF RIGHTS

The failure of WR to enforce any right or provision of these Terms of Use does not imply a waiver of such right or provision or any other rights

ENTIRE AGREEMENT

These Terms of Use constitute the entire agreement between you and WR with respect to the subject matter herein, and shall supersede all previous agreements, representations, discussions, negotiations, and understandings related thereto; (whether written or oral; implied or expressed).

CLAIMS OF INTELLECTUAL PROPERTY INFRINGEMENT

Written claims concerning intellectual property infringement must include the following information:

A physical or electronic signature of either the owner or of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
A description of the copyrighted work or other intellectual property that you claim has been infringed upon;
A description of where the material that you claim is infringing is located on the Services;
Your legal name, address, telephone number, and email address;
A statement by you that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law; and
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
